TERMS & CONDITIONS

These Terms govern use of explorerishikesh.com and booking of treks, rafting, camping, bungee jumping, adventure activities, tour packages, and hotel bookings. By booking, you agree to these Terms.
1. Definitions
“Services” means all bookable offerings on the site. “Vendor/Partner” means third-party operators (guides, hotels, transport, activity operators) delivering the Service. “Booking” means a confirmed reservation.
2. User Responsibilities
You must be 18+ to book (minors via parent/guardian). You must provide accurate information, review itinerary/inclusions before confirming, carry valid ID and required permits, follow all safety instructions from guides/instructors, and disclose any medical condition, disability, pregnancy, or fitness limitation before booking. You are responsible for loss/damage caused by your own negligence or non-compliance with instructions.
3. Booking Confirmation
A booking is confirmed only after payment and issuance of confirmation email/SMS/voucher. Availability is subject to Vendor confirmation. Report any discrepancy in confirmation within 24 hours. Corporate/B2B/agent bookings may follow separate commercial terms.
4. Online Payments
Prices are in INR and may change until booking is confirmed. Payments are processed via secure third-party gateways; we don't store full card details. You're responsible for accurate payment details — we aren't liable for bank/gateway-side failures. Prices may exclude GST, permit fees, or other statutory charges unless stated inclusive.
5. Adventure Activities — Risk Disclosure
Trekking, rafting, camping, and bungee jumping carry inherent risks including injury, drowning, falls, altitude sickness, and in rare cases death — even with all safety protocols followed. By booking, you voluntarily accept these risks, confirm you're fit to participate, and agree to use safety equipment as instructed. Explore Rishikesh facilitates bookings with certified operators but does not eliminate inherent activity risk. Operators may deny/stop participation for safety reasons (weather, water levels, health, intoxication) without refund if linked to non-disclosure or misconduct.
6. Health & Fitness Requirements
Activities may have minimum age/weight/fitness criteria (listed on the activity page). You must disclose heart conditions, respiratory illness, recent surgery, pregnancy, epilepsy, severe acrophobia, etc. before booking. Non-disclosure resulting in refusal of participation does not entitle you to a refund. Consult a physician before strenuous/high-altitude activities.
7. Third-Party Vendors
Many services are delivered by independent vendors (guides, rafting/bungee operators, hotels, transport). We select vendors with reasonable diligence but are not liable for their independent acts/negligence, except as required by law. Hotels follow their own check-in/house rules; transport timings are estimates.
8. Itinerary Changes
Itineraries are indicative and may change due to weather, water levels, road conditions, permits, or safety reasons. We'll offer a comparable alternative where possible; for company-side changes lowering value materially, a partial refund/credit may apply at our discretion. No compensation for Force Majeure-driven changes.
9. Cancellation & Refunds
Governed by our separate Cancellation & Refund Policy (see below), which forms part of these Terms.
10. Force Majeure
We are not liable for delays/failures due to events beyond our control: natural disasters, extreme weather, forest fires, roadblocks, pandemics, strikes, government/forest department restrictions, permit denials, etc. We'll offer rescheduling, alternative itinerary, or credit note where reasonable; refunds depend on what we can recover from vendors.
11. Limitation of Liability
Our total liability for any claim is capped at the amount paid for that specific service. We aren't liable for indirect/consequential damages, or for injury/death/loss arising from inherent adventure-activity risk, except where caused by our or our vendors' proven gross negligence or wilful misconduct. Nothing here excludes liability that can't be excluded under Indian law.
12. Intellectual Property
All website content (text, images, logos, itineraries) belongs to Explore Rishikesh or its licensors. No reproduction/distribution without written consent. “Explore Rishikesh” name/logo are protected trademarks.
13. Prohibited Conduct
No unlawful use, false booking/payment info, unauthorized system access, abusive behavior toward staff/guides, or unauthorized resale of our services.
14. Indemnification
You agree to indemnify Explore Rishikesh, staff, guides, and vendors against claims arising from your breach of these Terms, misconduct, or non-disclosure of health information.
15. Governing Law
Governed by Indian law; disputes subject to courts at Dehradun/Rishikesh, Uttarakhand.
16. Amendments
We may update these Terms anytime; continued use after changes means acceptance.
